San Bernardino County and Deputy John Monaghan

On February 9, 2003 reserve deputy John Monaghan was responding to a report of a burglary alarm. He spotted Jose Luis Perea driving slowly through the area and running a red light. Monaghan followed Perea, who got out of his truck and ran into a pallet yard. Monaghan fired his weapon at the suspect; two gunshots missed Perea, a third struck him in the neck, killing him instantly. Perea's family filed a wrongful death lawsuit against the county and the deputy claiming he used excessive force and acted maliciously in shooting and killing Perea. Under the proposed settlement, San Bernardino County would pay $220,000 to Perea's two sons and $230,000 to the family's lawyer. (May-03-05) [SAN JOSE MERCURY NEWS]
