Police Whistleblower
Kauai, HI: (Oct-19-07) Police Officer Darla Abbatiello brought a lawsuit against the Kauai Police Department, claiming that her civil rights and the protection offered within the Whistleblower's Protection Act were violated. The suit stems from a September 2004 complaint stating that Sgt. Irvil Kapua was selling an alleged drug dealer protection from prosecution. Records show that though the allegation was never tried in court, Abbatiello's supervisors at the time did give depositions within the suit backing up statements that Kapua had, on several occasions, dissuaded Abbatiello from pursuing drug dealers he claimed were not big fish; one of whom was convicted on charges related to dealing roughly $500,000 worth of methamphetamine. The suit also alleged Kapua threatened Abbatiello. As part of a settlement reached, the county agreed to pay Darla Abbatiello $980,000 in damages.
