Fatal Drug Bust
Louisville, KY: (Feb-16-08) Angela Bouggess, the mother of Michael Newby, brought a wrongful death lawsuit against the Louisville Metro government, after Officer McKenzie Mattingly fatally shot him in the back in a 2004 incident. The shooting reportedly occurred after a drug bust gone awry. Bouggess accused Mattingly of using excessive force when he fatally shot the 19-year-old after a scuffle. Records show that Police Chief Robert White fired Mattingly after an internal investigation found he did not face an immediate threat and had other options besides shooting. But a Jefferson Circuit Court jury acquitted Mattingly of murder, manslaughter and reckless homicide, and the city was forced to rescind his firing and give him $59,000 in back pay, though he didn't return to the force.
