Morton's Settles Wage and Hour Class Action


This is a settlement for the Employment lawsuit.

A wage and hour class action brought by waiters who worked at the national chain of steakhouses-Morton's -has been settled. The company has agreed to pay $13.4 million to the plaintiffs for up to a 4-year period as well as stock.

The class action was brought by Mark Johnson who worked as a waiter for Morton's Boston restaurant on Boylston Street from 1998 to 2002. The suit alleged that Johnson and other waiters were illegally required to give managers a portion of their tips, even when they were receiving less than full minimum wage. This practice allegedly took place nationwide, and is in violation of the federal Fair Labor Standards Act.
