Dockworker Awarded $257,500 in Age Discrimination Lawsuit
This is a settlement for the Employment lawsuit.
Houston, TX: Donald Wayne Smith, who was employed for 45 years as a dockworker with Central Freight Lines Inc, has been awarded $257,500 in an age discrimination lawsuit against his employer.
Smith was laid of in 2006, at the age of 62. In his suit he alleged that during his last months of employment he received a disproportionate number of disciplinary write-ups and that the company changed its layoff guidelines.
He further claimed that the new guidelines exempted part-time and supervisory employees, to ensure he was laid off while younger workers with worse work records remained employed.
As their defense, Central Freight claimed that the decision to terminate Mr. Smith and the guideline changes were the result of legitimate business decisions aimed at cutting costs.
