Diver Left Behind in Pacific Awarded $1.68 million


This is a settlement for the Negligence lawsuit.

Los Angeles, CA: The case of a man who was left behind on a scuba diving expedition off the coast of Santa Monica has been settled, the jury having awarded Daniel Carlock $1.68 million in damages.

Carlock was on a diving charter run by Sundiver Charters of Long Beach, CA, in 2004 near the oil rig Eureka when he surfaced some 400 feet away from the boat having experienced trouble clearing his ears.

The people aboard the Sundiver didn't see him so he tried to swim back to the boat but experienced leg cramps. The boat then moved to a second dive site 7 miles away as the dive master for Ocean Adventures had marked him as being aboard. Carlock was also mistakenly marked down has having done the second dive. It wasn't until 3 hours after the second dive that anyone realized he had been left behind. At this point the coast guard was contacted. Carlock was eventually picked up miles from the original dive site by a boat load of boyscouts crewing on the tall ship Argus.

Carlock alleged he developed post-traumatic stress syndrome and skin cancer from his exposure.
