Charleston, WV: Forty-seven defendants have been named in an asbestos-related lawsuit filed by Charles Judson Johnson and his wife Sharon Marie Johnson. According to their suit, Mr. Johnson was diagnosed with lung cancer on May 14, 2009, after having worked for FMC Corporation from 1972 until 1980 and for DuPont in 1980.
The defendants are being sued for negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn, according to the suit.

Joni L. Johnson’s father worked as a pipefitter for the defendants from 1948-1976. Her suit claims that multiple causes of action including, negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn. She may have suffered secondary exposure to asbestos from her father’s clothes, as a cause for her mesothelioma.

Salt Lake City, UT: A jury in Salt Lake City has awarded $5.2 million to a Utah woman who is dying of asbestos-related cancer. The sum is believed to be the largest asbestos-related award in Utah’s history. In its decision, the jury found three companies—Georgia-Pacific LLP; Hamilton Materials, Inc.; and Union Carbide—liable for Vickie Warren’s mesothelioma.
Ms. Warren was diagnosed with mesothelioma in 2007. As a teenager, she had often helped her father with home improvement projects, including smoothing out joints in walls which involved using a compound that would have contained asbestos. The jury found Georgia-Pacific and Hamilton Materials had produced “defectively designed” joint compounds made of asbestos-fiber products produced by Union Carbide. (wiredPRNews.com)
Boston, MA: People in Boston suffered an asbestos emergency on Wednesday, July 14, when a pipe on Harrison Avenue burst. It was about 10:00 pm when the incident took place, sending asbestos into the air and onto the roadway and nearby parked cars. No one was hurt.
The leak was successfully capped and environmental crews are now at the scene decontaminating the area. Health officials are also on scene testing the air for asbestos fibers. The asbestos fibers originated from the casing around the pipe.
The pipe belongs to Trigen, and a representative for the company told local news stations WBZ that “the pipe was in good working order and they have not had any specific issues with the system, which they inspect every day.”
