A roundup of recent asbestos-related news and information that you should be aware of. 

Asbestos Lawsuits

Four new asbestos lawsuits were filed in recent weeks, naming a total of 323 defendant companies between them. 

Charleston WV: A couple from New Martinsville has named 95 companies as defendants in their asbestos suit, alleging that those companies are responsible for William R. Henthorn’s mesothelioma, for which he was diagnosed in September. 

According to the suit, Henthorn and his wife, Eva Louise Henthorn, claim the defendants caused the development of malignant mesothelioma because they exposed him to his asbestos. Mr. Henthorn was employed at the PPG Natrium Plant in New Martinsville from 1959 until 1977.

Kanawha, WV: The widow of Dwain L. Chenoweth, who was diagnosed with lung cancer on April 13 and subsequently died has filed an asbestos claim naming 72 companies as defendants. In her suit, Josephine Chenoweth alleges the defendants caused her late husband’s lung cancer and death by exposing him to asbestos and asbestos fibers during his career at Union Carbide Corporation from 1959 until 1999.

Charleston,WV:  A couple from Georgia have filed an asbestos suit naming 80 companies as defendants, alleging that the companies are responsible for Benny Charles Taylor’s lung cancer development.

The suit claims that on July 9, 2009, Mr. Taylor was diagnosed with lung cancer, and that he developed that cancer through exposure to asbestos and/or asbestos fibers at work. Mr. Taylor was employed by Delta Construction, J.B. Stevens, CC Taylor & Son and J.A. Jones Construction Company from 1955 until 2000.

Charleston, WV: Ethel M. Barker, the widow of Marion Paul Barker, who was diagnosed with lung cancer on May 1, 2008 and subsequently died on November 4, 2008, has filed an asbestos suit naming 76 companies as defendants. Mrs. Barker claims that those defendants are responsible for her husband’s illness and resulting death.

The suit alleges that Marion Paul Barker was exposed to asbestos and asbestos fibers throughout his career, and that the defendants were negligent in allowing her late husband to be exposed to the asbestos.

Asbestos Settlements

Red Bank, NJ: A 55-year-old man was recently awarded $3.72 million settlement of an asbestos lawsuit.

Howard Bird, who worked as an electrician, encountered asbestos-containing products on job sites. He sued the manufacturers of the asbestos-containing products for liability after being diagnosed with asbestos mesothelioma. (TheDailyJournal.com) 

Asbestos Law

Rochester, NY: Rochester contractor Keith Gordon-Smith and his company Gordon-Smith Contracting, were convicted by a federal jury last week for violating the Clean Air Act and exposing workers and the public to toxic asbestos during a demolition project at Genesee Hospital. 

They were convicted of eight counts of asbestos-removal violations and lying to hide the violations, which occurred between January 2007 and February 2009. During the case, prosecutors reportedly said asbestos fell like snow on workers who wore no protective suits. 

Gordon-Smith faces up to five years in prison and fines up to $250,000 on each count. His company could be fined up to $500,000 on each count. (WallStreetJournal.com)
