Charleston, WV: Layman B. Saltz and his wife, Patricia K. Saltz, from Lufkin, Texas, have filed an asbestos suit naming 37 companies as defendants, and alleging that those companies are responsible for Mr. Saltz’s diagnosis of asbestos mesothelioma. He was diagnosed, according to a complaint, on December 29, 2010.
The defendants are being sued upon theories of negligence; contaminated buildings; breach of expressed/implied warranty; strict liability; intentional tort; conspiracy; misrepresentations; and post-sale duty to warn, according to the suit.

Charleston, WV: William B. DePaoli Jr, from Canonsburg, has filed an asbestos claim alleging that during his employment he was exposed to asbestos which subsequently led to his diagnosis of malignant mesothelioma.
DePaoli Jr. was exposed to asbestos during his employment at various job sites around West Virginia, according to his complaint. The suit alleges that the defendants failed to advise DePaoli of the dangerous characteristics of their asbestos and asbestos-related products; failed or omitted to provide him with the knowledge as to what would be reasonably safe and sufficient apparel and proper protective equipment and appliance; failed to place warnings on containers; and did not recommend methods to improve the work environment.

Charleston, WV: Five separate asbestos lawsuits filed recently in Kanawha circuit court have named a total of 159 companies as defendants.
Ronald W. Cloherty and Debra L. Cloherty; David Edgell and Loretta Edgell; Betty I. Kucera; Livio M. Miller and Linda K. Miller; and Nathan Shrewsbury claim the 159 defendants are responsible for asbestosis and lung cancer diagnoses, according to the five complaints.
Mr. Miller was diagnosed with asbestosis, while Mr. Cloherty, Mr. Edgell, Kucera and Shrewsbury were diagnosed with asbestosis and lung cancer.
The plaintiffs claim they were exposed to products that contained asbestos and/or asbestos fiber, and that the defendants failed to remove the asbestos materials and/or other dangerous ingredients and products.

Saratoga Springs, FL: An old eatery located on lakefront property off Crescent Avenue on Saratoga Lake, that the city of Saratoga Springs purchased in 2005, will undergo asbestos removal and will have a qualified supervisor in place to oversee the removal, city council voted last week. City leaders say this it the first step in getting the $2 million site ready for public access.
The council authorized $3,700 for CA Smith to prepare and review bids for a contractor to clean up the interior of the former Waterfront Restaurant.
According to the Timesunion.com, the city has a 1.8 million, three-phase plan to turn the property into a public park with restrooms, parking, a playground, beach and fishing pier. The plan was prepared in 2008, however, poor economic conditions prevented the city from getting started on the project. (timesunion.com)
Denver, CO: The Frisco Holiday Inn, its owner and manager have all been indicted by the Colorado State Grand Jury for allegedly exposing guests and housekeeping staff to asbestos in November 2009.
According to the three-count indictment, Adam Pietraszek, the owner of the Frisco Holiday Inn, and hotel manager Nikolai Semenshin, as well as two employees of NHV Construction—owned by Pietraszek—failed to obtain a permit in October 2009 for asbestos abatement related to renovations they were performing at the hotel.
