The class action for Indirect Purchasers must affect millions as most people have bought one of these chocolate bars over the past few years. I hope that after the class action settlement the price should go down which is good news for all those chocoholics out there.

Hi Kristin, you need to submit your claim over at the chocolate class action website link shown in the post above–for indirect purchasers; however, you first have to wait for the fairness hearing to happen for the Cadbury portion of this class action–the other defendants are still in litigation and have not reached a proposed settlement yet. So your best bet is to check http://www.chocolatesettlementindirect.com/ in order to keep up to date on when the fairness hearing has happened and when your claim should then be submitted.

The price of chocolate bars (candy) "NEVER" goes down, just the size of the package. A number of years ago the price of sugar skyrocketed, we were told the price of candy had to increase accordingly, and it did. The price of sugar dropped, eventually, but NOT the price of candy. Manufacturers NEVER pass on cost reductions, only cost increases.

Hi Devlin…agreed…but now the question is…has there been collusion among the chocolate manufacturers? Cadbury's settled, so now we'll have to see what happens with Hershey, Nestle and Mars…

So, where does WE the consuming Public fit with respect to this lawsuit? What "damages" if any ,is isssociated with "Candies", except Price fixing?

    • LAS_Admin October 17, 2011 at 9:37 am

Hi Jwimbley, Uhh…price fixing is where we fit in. The lawsuit alleges that chocolate prices were artificially maintained–or increased–and we, the consuming public, paid for it. The "damages" are the damage that was done to every chocolate-purchaser's wallet. Allegedly overpaying for chocolate. The lawsuit is strictly about price fixing.

Recalling the Sothebys-Christies anti-trust "roll-ever" suit, I hope this sweet-tooth imitator suit doesn't leave a sour taste in our mouths!
