Huntington, WV: A man from Point Pleasant has filed an asbestos lawsuit against his employer, alleging that during his work on the Motor Vessel Leila Shearer he was exposed to asbestos fibers.
The ship, owned by defendant Campbell Transportation Company, was temporarily taken out of service for asbestos abatement in 2008. However, prior to that, Martin Woodall claims he suffered from lung dysfunction, and that his lung dysfunction and other problems are due to his exposure to asbestos fibers on the ship.
Woodall claims in his suit that “he became sick, sore, lame and disordered; lost wages and his earning capacity; experienced pain and suffering; incurred substantial medical costs; and sustained disability because of his asbestos exposure.” Mr. Woodall is seeking compensatory damages, plus attorneys’ fees and other costs. Madison County, IL: A couple from Massachusetts have filed an asbestos lawsuit against 45 defendant companies and the US Navy, alleging that the husband, Mr. Ronald A. Nichols, developed asbestos mesothelioma as a result of exposure to asbestos-containing products throughout his working life.
Mr. Nichols worked at the basic training electrician’s mate school for the U.S. Navy in 1957; worked as a machinist mate on the USS Hailey from 1957 until 1959; worked as an assistant parts manager at McKulkin Chevrolet from 1959 until 1960; worked as an operator, laborer, boiler and furnace worker at Gas Service Inc. from 1960 until 1987; performed home remodeling from 1965 until 1967; and worked as a shadetree mechanic from the 1950s until the 1960s, according to the complaint.

Charleston, WV: An asbestos-related lawsuit filed recently has named 61 companies as defendants. The two co-executrixes of the estate of Nelson Eugene Walker filed on behalf of Mr. Walker’s estate. Walker was diagnosed with asbestos mesothelioma in July 2009 and died from complications related to the illness on November 23, 2009, not quite four months after his diagnosis.
Debra L. Church and Carol J. Boyd, the executrixes, allege that Mr. Walker was exposed to asbestos-containing products during the course of his work for the various companies. The defendants are being sued for negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Largest Mesothelioma Verdict in the History of New Jersey Asbestos Litigation
New York, NY: A unanimous decision issued on April 5, 2010 by the New Jersey Appellate Division has upheld a $30.3 million jury award in the New Jersey asbestos lawsuit filed by Susan M. Buttitta, both individually and on behalf of the estate of her late-husband Mark Buttitta. Mr. Buttitta died of mesothelioma, a rare and fatal cancer caused by asbestos exposure. The jury verdict is the largest mesothelioma award in the long history of New Jersey Asbestos litigation.
According to the published opinion, Mr. Buttitta was exposed to asbestos in the workplace during the 1970s when he was employed at warehouses that distributed asbestos-containing materials including brakes and clutches. He worked as a “parts picker” which required him to handle asbestos products and sweep up dust that contained asbestos. The landmark mesothelioma verdict was decided against a supplier of asbestos fiber, which was incorporated into automotive parts, and the manufacturer of automotive clutch products that contained asbestos. Susan Olsen has re-filed the asbestos lawsuit her and her now deceased husband, Merlin Olsen—star of Little House on the Prairie—had submitted while he was still alive. The original suit had named 38 defendants alleging they had exposed Merlin to asbestos and were negligent in so doing. Susan Olsen’s new suit also names executives at NBC Studios and 20th Century Fox Film Corp., as well as paint manufacturers Sherwin-Williams. (TMZ.com)
St. Clair Co., IL: St. Clair County in Illinois saw five more asbestos lawsuits filed at the end of March. Among them is a complaint by Mr. Raleigh Yarberough, who worked as a seaman in the U.S. Navy from 1956 until 1960 and then as a service worker at Gross Air Heating and Cooling from 1960 until 1969. He also worked as a machine operator at Service Heel Company from 1971 to 1975 and as a carpenter and mill operator in 1976.
Mr. Yarberough’s complaint names 26 defendant companies which contributed to his developing asbestos-related lung cancer, because he handled asbestos-containing products while working for them.
Another of the five suits was filed by Charles Graham on behalf of his father, Richard Graham, who was diagnosed with asbestos mesothelioma in November 2006, and subsequently died in January, 2007. His suit names nine Read the rest of this entry »

St. Clair County, IL: Three more asbestos lawsuits were filed recently in this county. Among them is a suit filed by a couple who allege that the husband, James Keller, developed pleural plaques as a result of exposure to asbestos through his work. Mr. Keller worked as a lifeguard at a YMCA from 1969 until 1971; as an assistant team manager at Roadway Express until 1977; as an assistant terminal manager in 1978; as a laborer, estimator and vice president at James A. Keller Inc. from 1969 until 1994; and as the vice president and owner of Grayhawk from 1994 until now, and during his time at these various positions he was exposed to asbestos containing product. The asbestos-related suit names nine defendants.
A second couple, the Brocks, filed an asbestos-related complaint naming 10 companies as defendants. Susan Brock developed lung cancer after her work as a kitchen server at Lutheran Hospital from 1966 until 1969, as a packer and assembler at General Electric Co. from 1969 until 1974, as a machine operator at Harvester from 1976 until 1981, as a painter at Rosener Decorating from 1983 until 1986, as a truck driver and loader at Purolator Courier from 1986 until 1989, as a package handler and courier at Fed Ex from 1989 until 1997, as a driver for Statewide Medical from 1998 until 1999 and as a truck driver from 1999 until 2007. Mrs. Brock is now disabled and disfigured as a result of her asbestos illness.
