The suit, currently seeking class action status, claims that the electronic throttle system installed in the company's full line of cars - including luxury brand Lexus vehicles - is improperly wired, potentially leading to abrupt acceleration that could result in collisions.
An accident resulting in the deaths of a family of four driving a Lexus ES 350 recently prompted the automaker to issue a recall of 3.8 million floor mats that it blamed for the incident. Toyota charges that the mats may become lodged against the accelerator pedal, causing the sudden bursts in speed.
The Department of Transportation has claimed that the recalled autos possess an "underlying defect" that leads to the impromptu expedition, according to ABC news.
