Nursing Home Giant Focus of Class Action Lawsuit

Bremerton, WAA class-action lawsuit alleging nursing home negligence has been filed against one of the largest operators of nursing homes in the country. Hardly surprising, given the widespread concern over nursing home abuse. Meanwhile, a blogger once employed at one of the nursing homes cited in the lawsuit tried for a year "to change the way they did business and improve the care they gave to their residents, (but) I finally had to give up and leave."

Among 15 facilities in the State of Washington named in the suit are Bremerton Health and Rehabilitation Center, Forest Ridge Health and Rehabilitation Center of Bremerton and Island Health and Rehabilitation Center of Bainbridge Island.

Nursing HomeThe federal lawsuit, filed in August in King County Superior Court and moved to Federal Court September 5th, was motivated from the death of a stroke victim who resided briefly at one of the Extendicare-owned facilities. The victim, only 49, succumbed in 2007 after receiving less-than-adequate care for a tracheotomy, it is alleged.

Lawyers for the lead plaintiff, who is the woman's father, indicate that more plaintiffs have emerged since the lawsuit was filed, and it is estimated that as many as 3000 plaintiffs could be represented in the lawsuit. The class action cites the facilities for failing to provide the excellent, and adequate care promised.

While promoting the availability of skilled nursing care at its Washington facilities, it is alleged that Extendicare was not in a position to deliver the service and care promised due to under-funding and under-staffing.

That sentiment seems to be echoed by former employees of the facilities, or those who have had some prior connection. "I want to say there are many good people that have worked and still do work there," writes a former staffer. "Unfortunately the parent company Extendicare is only about (the money). The patient care is at the bottom of the list. I tried to complain to the regional office about the things I saw while I was there, but always had the door shut in my face."

"I also worked at Bremerton Health for a brief time," writes another former employee. "My patient load was way beyond what could be managed by one person. I have 15 years experience and have always been considered very fast and efficient. When I approached my supervisor with the fact that I had 4 patients I was not able to get to, I was told that was okay just pass that info onto the next shift...that is 8 hours these people spent laying in their urine and feces with no turning, food or care of any kind. I quit with a heavy heart…"

The nursing home negligence lawsuit alleges that gross deficiencies in the level of required patient care were identified in State surveys of the 2 Bremerton facilities in 2006, and again in 2007. It is also alleged those deficiencies were above the national average.

A spokesperson for Extendicare maintains that the allegations of nursing home negligence and nursing home abuse are false, and that the company is completely focused on delivering quality care.

Extendicare's parent company, Extendicare REIT, is one of North America's leading nursing home providers, with a roster of 268 facilities throughout North America.
The class-action lawsuit seeks monetary damages averaging $10,000 per person.

I think the law suit is very justified, I had worked at Bremerton Health and Rehab for almost three months. We were on almost a daily basis short staffed, have a DON that knows nothing about her patients or staff and h as no desire to know. The facility is so top heavy with non essential people that literally walk the halls with coffee cups in their hands or a cell phone wondering aimlessly with nothing to do.They will either walk past call lights or spend twenty minutes trying to find someone to hand a resident the remote to his tv. Anyone that challenges or shows concern for what goes on there is usually terminated. There are nurses there that give all their PM meds and insulins by 3 in the afternoon and sit or go outside and smoke the next 3 1/2 hours of their shift. I had worked on mountainview one shift and I had a resident with severe COPD and she seemed to be struggling so I got my stethoscope and oximeter listened to her lungs and she told me that was the first time since she had been there someone has listened to her lungs, she has since moved to a different facility. It does seem like the bottom line is the main concern at BHRC. They have CNA's go to hospitals to do an admission assessment for admission to BHRC, I feel like this is why so many people are brought in and their not able to receive the care they deserve. They have a staffing person that you have no access to if anyone calls in, so the nursing staff has to spend at least an hour trying to find someone to come in. There is so much nepitism there, everyone in management or one of the do nothing jobs is either married to or is the sister or daughter or son of someone in a management position. The way the managers dress there is so unprofessional, you would think it is casual Friday every day. There are two of the girls there that wear leggings with short tops to where you can see most of the leggings and boots, something you might wear to a bar, not to work. The DON wears tight jeans with boots and low neck tops, wear to a bar, very unprofessional. The managers see everyday how their staff is struggling, never once were we offered any assistance by our managers, they would have a daily meeting, never are any nurses asked what is going on with their residents, most of the residents have never met either the unit manager or any of the upper management. Me and the nurse on the opposite hall from me were never given any orientation to the unit, we didn't have a unit manager we could ask questions, thrown on the cart by myself the very first day, but we were expected by osmosis to know all their paper work, about notifying the M.D. The physicians you have there are an issue too. They don't like to be faxed, you have to call, you have to spend an hour with each call filling out what they call an SBAR, and you have to read this sheet over the phone for each resident you are calling about, instead of doing what you normally do when call an M.D. , give their vs and what the problem is and if you don't read it exactly the way it is written the manager receives a call from the M.D. If you fax they will usually say they will address it on rounds which is every wed and there are times they didn't come in so it wouldn't be addressed for 2 weeks and heaven forbid and your diabetic and you seem non compliant to the doctor and they will do nothing to adjust your inslin or medication because to them you are non compliant. I had one lady that was on prednisone and her morning fasting blood sugars would run in the high 200's and throughout the day they would be in the 3-400's, i would send the doctor a copy of her blood sugars, but they would do not adjustments on her insulin, because at one point in time she would drop, but during my three months there they were consitantly running that high and they would do nothing to bring it down, she is now on hospice and they have taken her off most of her meds and her bs aren't as high as they were. They have some very good staff but with the everyday understaffing people just get burned out.
