Best Buy "Price Match Guarantee" Class Action Litigation

Competitor SaleBest Buy is the largest specialty retailer of consumer electronics in the United States and Canada. As part of its advertising, promoting and selling of goods and services, Best Buy promotes a "price match guarantee". Best Buy guarantees that it will match any local competitor's lower price and if a customer has already purchased the product, Best Buy will refund the price difference, plus an additional 10% of that difference. The suit alleges that Best Buy fails has a policy and/or practice of not honoring its "price match guarantee" when customers request that Best Buy match a local competitor's lower price. The suit seeks damages for those damaged by Best Buy's policy and/or practice and its failure to abide by its expressly stated and advertised "price match guarantee".

On Sunday 3/6/2016 at 1:34 PM. I was at Walmart at Milwaukee Ave, Burlington WI. 53105 and found a Samsung TV Model # UN60JU6500FXZA that was priced at $550.00. The TV was New and Not a Open Box Item either. Walmart only had one in stock and I wanted to purchase at least one more of the TV's. I used my phone to find if any other retailers sold the same TV and if they would do a Price Match. I found that Best Buy Carried the same model and I was aware of Best Buy Price Match Guarantee. Since I was more then 30 minutes away I called my son to go to Best Buy and purchase another TV there with the Price Match Guaranty. When my son arrived at Best Buy at 2710C Green Bay Rd., Racine, WI 53406 he contacted a sales person who referred him to a Manager. The Manager said that he would not sell the TV to my son at that price because it had to be a mistake. My son then called me to inform me of the situation. I then talked to the manager on duty at that time who said to purchase the TV so that I would have proof of the price because he believed that Walmart had made a mistake and would not sell the TV to me at that price. I purchased the TV and took picture of the receipt and the box window, showing the Model number, with my cell phone and sent it to my son who was still at the Best Buy. He said he showed the manager and the manager still refused to sell the TV to my son. I decided I would call the 888 BESTBUY number because the Best Buy manager was not following the Price Match Guarantee. I talked to a Customer Service Person who took all of my information and was told they would call me back. On 3/9/2016 I called 888 BESTBUY again because they had not called me back. They suggested that I go over to the Racine Best Buy and talk to a manager again. I drove to the Best Buy at 2710C Green Bay Rd. and talked to a manager named Patrick Warnecke. I told him the story of what happened on 3/6/2016 and showed him my paperwork and the cell phone pictures along with text messages with my son during the situation. He verified all the information and informed me he could sell me the TV and price match if Walmart still had them in stock at that price. He called the Walmart in Burlington WI. who confirmed the price but told him there was no more in stock. The manager then told me because there was no more in stock that he would not be able to sell me the TV using the price match. I again pointed out the fact that when I was at Walmart and sent my son to the Best Buy on 3/6/2016 that Walmart did have them in stock and so my son should have been able to purchase the TV with the price match. It was only because the manager on Sunday told me to buy it that they were out of stock at that point. The manager said that because they didn't have them in stock at this time and he could not vouch for what the manager on 3/6/2016 did, he would not price match the TV. The manager said I could call corporate and tell them of the situation. I called the 888 BESTBUY service number again and repeated all the information on what had happened again. I was given a Case ID. 176122048 and was told I would be called back. I was not called back after two days so I called Best Buy again and talked to another person and was given another Case ID. 176232447 and was told I would be called back. I was called back on 3/15/2016 by a customer service person from Best Buy who said they would talk to the Racine, WI., Best Buy and call me back. They called me back and informed me that they would stand by the manager from the Racine, WI. Store and not honor the price match.

Do I have a case here and what should I sue for? I would like for Best Buy to honor the price match or refund the difference between the price at this time and the $550.00 I paid at Walmart if that is what I can do.
