Embark Resistance Cord Lawsuit



Lawyers are investigating possible defective products class action lawsuits, alleging the Embark Resistance Cord was defectively designed putting consumers at risk of injury. The Embark Resistance band was sold by Target Corporation and was recalled in September 2011, due to reports of injury, including permanent vision loss.

Embark Resistance Cord Recall

embark_resistance_cordsOn September 8, 2011, the US Consumer Product Safety Commission and Target Corporation announced a voluntary recall of Embark Resistance Cords and Cord Kits. The recall was announced due to reports of the cord accidentally releasing the black plastic ball, which posed a risk of injury to consumers. Target reportedly received three reports of injury linked to the Embark Resistance Cord, including two reports of permanent vision loss.

Included in the recall were around 447,000 Embark Resistance Cords sold at Target stores and online from July 2009 through August 2011.

  • Embark Medium (tension) Resistance Cord (blue)
  • Embark Heavy (tension) Resistance Cord (black)
  • Embark Resistance Cord kit (set of three cords in green/blue/black stored in a mesh bag).

Embark Resistance Band Injuries

Injuries linked to Embark Resistance Bands include permanent eye injuries, head or face injuries, eye contusion, and other facial injuries requiring surgery. One consumer, writing to the CPSC, reported she experienced a broken lower eye socket, traumatic cataract, traumatic glaucoma, and corneal damage requiring two surgeries to repair the damage caused when the ball from the Embark Resistance Cord struck her in the eye. Although she retained her vision, she says she has constant inflammation and pain.

Embark Lawsuit

According to reports, one consumer who suffered a permanent eye injury filed an Embark defective product lawsuit, which was settled for an undisclosed amount. A different lawsuit (case number 2:14-cv-04520 in the Eastern District Court of Pennsylvania) alleged the plaintiff suffered serious eye injuries, including eye contusion and traumatic iritis, and required surgery to treat his injuries. A judge reportedly allowed that lawsuit to go ahead, but has denied the plaintiff's motion for punitive damages. That lawsuit seeks in excess of $150,000.

Lawyers are investigating reports of injuries linked to use of the Embark Resistance Cords.
