Hurricane Ike Victims Fight for Compensation


Windstorm Insurer May Not Pay for Water Damage

Hurricane Ike victims living on the Texas coast have been told that they may not receive compensation from the Texas Windstorm Insurance Association (TWIA) for water damage resulting from the hurricane's storm surge.

The TWIA has said that it intends to pay Gulf Coast policy holders for wind damage, not damage resulting from water surge. However, the policy holders claim that there would be no water surge damage without the wind. The consumer group Texas Watch agrees, stating that water damage should be covered, and that the TWIA's stand on this issue could set a dangerous precedent.

Before Hurricane Ike struck I paid the premium via the internet and paid exactly what Nationwide stated. We received a letter stating that since we did not pay the amount due Nationwide would not be covering us. We did pay the amount that Nationwide stated was due. We then (a few days ago) received a check from Nationwide in the amount of a refund. If we did not pay the amount due then why did they send us a refund? Now since we are cancelled our mortgage company has purchased high risk insurance on us and it will be practically impossible for us to obtain insurance at another place. Why Nationwide did this during and/or at the time of Hurricane Ike? We would like to know. This should not be legal and the reason they gave us is unacceptable to us since they returned some money. We did suffer some damage and cannot file a claim because we have no insurance. Their timing was unacceptable. Isn't there a law which states that insurance companies cannot do this a certain amount of days before and/or after?
