Oreck Faces Federal Consumer Fraud Class Action over Flu-Fighting Halo Product Claims
Los Angeles, CA: Oreck is facing a consumer fraud class action lawsuit alleging that claims the company makes about its "flu-fighting" vacuum cleaners and air purifiers are false and misleading.
The federal suit claims that Oreck, in its adverting, states its Halo vacuum and air purifier can "eliminate common viruses, germs and allergens, thereby helping to prevent the illnesses they cause." The lawsuit claims that Oreck "represented to consumers that the products used scientifically proven technology to eliminate common viruses, germs and allergens, thereby helping to prevent the illnesses they cause." And, Oreck claims its products can prevent colds, diarrhea, stomach upsets, asthma and allergies. "Unfortunately for plaintiffs and the class, defendants' claims are not adequately supported by credible, scientific testing or other substantiation, and are not true."
The suit goes on to state that "... these representations were false, deceptive and inaccurate. As such, Oreck's actions violated the Magnum Moss Warranty Act ('MMWA'), breached express warranties made by defendants, breached implied contractual warranties imposed by law, violated numerous California consumer protection statutes, and violated New York consumer protection statutes and common laws."

I believed my Mothers apartment had mold in it, before she moved, because 1 weeks after being there, I was unable to breath very well and I got lesions on my arms and legs, I went to Ohio State University and Dr. Washington in Columbus, Ohio with the diagnosis.
So to help with my health and hers, I bought the Oreck AIR109 at that time, because of the advertisement that was all over the television, in the mail and advertised everywhere. I even researched it on the internet.
I moved back to California in September of 2013, it was in storage until January 2017, I tried replacing the filter then but could not find one or the unit, but I had visitors for several months and am just now dealing with this situation.
After contacting Oreck, the unit, after only 4 years, the unit no longer exits, I spoke with someone after about 10 minutes of having the site online and they said they do have a replacement Hepa filter for that unit but it was on back order for 2 to 3 months and was there anything else the could help me with. I was so mad I wasn't thinking and just closed the sight. My after thought was I should have printed their response, I apologize for that.
I believe they knew they were not going to be making those units very long and parts would be unavailable. This is not a cheep unit, I paid over $500 for this unit, and the filter obviously didn't last very long because it was only used in Ohio for about 4 months. I can find the receipt for this unit.
I find it only fair that I am refunded for the unit considering they had no intentions of continuing to manufacture this unit and sell it for over $500.
The cost you take to help me get refunded and the time it's taken me to try and find a Hepa filter that would work with this unit that is if it really did what it was supposed to and had an actual heap filter.
I am obviously upset about this matter but having the proper unit in my home is very important because of my illness, I need a unit that is truly going to do what it says and is truly a Hepa Filter Unit.
