Sears Peeping Tom

A Sears employee has been arrested for secretly videotaping women in Sears changing rooms, in a case that is being referred to as the Sears Peeping Tom case. Sears employees who may have been caught on the camera are now investigating a Sears employee lawsuit and company could face a Sears customer lawsuit as well. The fitting rooms and bathrooms were public and women and children may have been recorded changing in the rooms.

According to reports, Alejandro Gamiz, a 27-year-old maintenance worker at the 12121 Victory Blvd Sears location in North Hollywood, admitted to members of the Los Angeles Police Department (LAPD) that he had been secretly recording women in the Sears fitting rooms and bathrooms for three years. He was arrested after a loss prevention employee noticed something suspicious during a routine inspection and Sears notified the authorities.

According to Reuters (05/01/12), Gamiz used up to 60 secret cameras in the fitting rooms and bathrooms. The rooms were public and may have been used by many women, teens and children, meaning Gamiz may be guilty of child pornography. Reports indicate that footage obtained during the recordings was posted on a website called peepingtomsawyer.com. The website has since been taken down.

Some Sears employees allege that Sears knowingly allowed Gamiz to continue his secret recordings for up to four months before the company warned employees or told the police. They are reportedly now investigating a possible lawsuit against Sears, alleging the company did not move quickly enough to alert the authorities or to protect employees.

Sears responded to the allegations saying it was fully cooperating with local authorities and that it would take disciplinary action if other employees were involved in the secret recordings or if they new of the incident but failed to report it.

Given the number of hidden cameras allegedly used by Gamiz, quite a number of Sears customers could have been secretly filmed in Sears changing rooms or Sears bathrooms. Female customers may have been filmed, and the film may have then been uploaded to Gamiz' website, peepingtomsawyer.com. Investigations are now under way to try to determine those Sears customers who may have been victims of the Sears peeping Tom, as those customers may have grounds for a Sears Peeping Tom lawsuit.

According to some attorneys, customers of Sears do not necessarily have to prove they were in a video to join a lawsuit. If they used the bathroom or changerooms during the time filming occurred, even if they cannot show they were in the video, they could be eligible to join a lawsuit. Sears could be held finanically responsible for punitive damages if there is evidence the company covered up knowledge of the employee's secret filming or if the company delayed notifying the proper authorities.
