Everhart Trucking LLC and R&T Trucking

On June 23, 2004 Emily Van Dyke was a passenger in a car pulled over for speeding. Just then, truck driver David Gale lost consciousness due to his degenerative multiple sclerosis and hit the Allegan County sheriff's deputy's cruiser, starting a chain reaction crash. The car Van Dyke was in was pushed into a ravine by the sheriff's cruiser and burst into flames. Van Dyke was killed in the accident and her parents filed a wrongful death lawsuit. The case claimed the trucking companies should have known Gale had a medical condition that could impair his driving. An insurance company for Everhart Trucking LLC and R&T Trucking has agreed to award the family the highest insurance pay out limit of $1 million. (May-25-05) [M LIVE]
