Dialysis Lawsuit Update: The Latest on Granuflo Lawsuits

Dialysis Lawsuit Background:

Granuflo and NaturaLyte lawsuits have been filed against Fresenius Medical Care North America, the manufacturer and distributor of dialysis products Granuflo and NaturaLyte, alleging their actions, i.e., alkali dosing errors, led to the wrongful deaths of some dialysis patients. Both Fresenius and Davita operate hundreds of dialysis centers across the US and dialysis patients who were treated at a Fresenius or Davita dialysis center may not have realized that a dialysis injury may have been the result of a Granuflo dosing error.
• Granuflo lawsuits and Fresenius dialysis center lawsuits were filed after a Naturalyte GranuFlo recall. The lawsuits allege that Fresnius knew of the serious health risks associated with their product, but withheld information from physicians who were therefore unknowingly putting their patients at risk for life-threatening adverse events.

• Evidence to support these allegations comes from a memo sent internally to Fresenius clinics in November 2011, which states that in 2010 there were 941 instances of sudden cardiac arrest that took place during dialysis treatment at 667 of their own clinics.

• The memo also issues a warning to physicians about the necessity of monitoring patients’ bicarbonate levels during dialysis. However, other dialysis clinics were not issued the memo containing critical medical information. It wasn’t until the internal memo was leaked to the Food and Drug Administration that a warning letter was sent to all healthcare providers across the US. This happened in March 2012, at which point many more people had suffered adverse events.

• Recently, Fresenius settled a wrongful death case for seven figures to the surviving children of Teresa Gaytan, a mother of five who died during a dialysis treatment at a Fresenius Medical Care facility in Illinois. She was taken off life support and died on March 10, 2009. According to the lawsuit, Teresa Gaytan “sustained massive blood loss as a result of hemorrhage from the dialysis circuit during dialysis treatment at the center.”

• The dialysis lawsuits claim the problems that caused deaths such as that of Teresa Gaytan, were caused by dangerously high levels of bicarbonates in the dialysis treatment, and have affected thousands of dialysis patients nationwide.

Dialysis Lawsuit Update:

Granuflo Multi-district Litigation (MDL)
• Currently, over 300 Fresenius dialysis lawsuits have been filed in courts across the United States. In these lawsuits, plaintiffs allege that their hemodialysis treatment with GranuFlo or NaturaLyte led to a sudden cardiac arrest, heart attack or death.

• Due to the large number of Fresenius dialysis lawsuits, which make similar claims, the US Judicial Panel on Multidistrict Litigation (MDL) has ordered that all lawsuits be centralized in the District of Massachusetts before US District Judge Douglas P. Woodlock.

• The lawsuits were consolidated into MDL No. 2428 on April 5, 2013.

• An MDL is more practical for both the plaintiffs and the judicial system, as it allows for than trying all cases on an individual basis. An MDL is a special federal legal procedure that speeds up the process of handling complex cases such as complex product liability lawsuits. An MDL can take place when civil actions involving one or more common questions of fact are pending in different districts. Additionally, MDLs reduce the likelihood of duplicative discovery and conflicting pretrial rulings from different judges.

• On June 21, a group of six lawyers filed a motion requesting they be appointed leadership roles in the newly formed MDL.

• On July 16, court documents show the judge overseeing the GranuFlo recall litigation issued an order that established the proceeding’s plaintiffs' executive and steering committees. (In re Fresenius GranuFlo/Naturalyte Dialysate Litigation, MDL No. 2428).

Product History
• Both Fresenius Medical Care products - Naturalyte and GranuFlo- are used in the treatment of acute and chronic renal failure during hemodialysis. The concentrate is formulated to be used with a three-stream hemodialysis machine, which is calibrated for acid and bicarbonate concentrates, according to the FDA safety recall initiated in March 2012.

• The recalled Naturalyte Liquid Acid Concentrate and Naturalyte GranuFlo (powder) Acid Concentrate was manufactured and distributed from January 2008 through June 2012.

• GranuFlo and NaturaLyte both use acetic acid and sodium acetate which can lead to additional presence of sodium acetate in the dialysate and, in turn, can result in higher levels of bicarbonate in the bloodstream. Higher levels of bicarbonate can lead to Granuflo side effects including cardiac arrest, cardiopulmonary arrest, metabolic alkalosis, stroke, low blood pressure and even death.

Once again our judicial system has let all of us down. Big BILLION dollar companies like Fresenius are able to get away with murder and walk away with just paying $250 million and even then 90% of the victims wont get a dime. I have lost faith in this whole thing. Lost my mother to all this and will never have her back but I had hoped that justice would be served, how wrong I was. God will judge in the end.

This is all I know. The settlement was reach for $250 million from Fresenius. Unfortunately, some law firms did not submit their opt-in or opt-out paperwork on time so the deadline was extended to May 10, 2017. As usual our legal systems is letting alot of people down but I am hoping that the settlement will be funded soon for those who were involved in the tort. I have contacted my lawyers to see what the update is now. We pray that this will not go on much longer!

My sister was on dialysis and had a major heart attack on August 16 2011 I haven't heard anything on the case she was only 51 when she passed away. I sent all paperwork to a lawyer in Louisiana.can anyone help I don't know the lawyers name

My husband had been on Dialysis for around seven years (has been on Dialysis for 13 years so far) @ the time Fresenius almost killed him. They had HIM call me and tell me that he was in the process of having a Heart Attack, and to meet them @ the hospital. He could barely talk. I was so scared and upset. Later the woman that was over the place had just been promoted to the head of that center. She did not know anything about what was going on. She keept telling me "so sorry for this I did not know about the Granuflo. This was when only a few centers knew and they did not share this w/her, and she almost killed my husband. He had never been the same. He use to weigh 250 now he weights 135. He is skin and bones litterly. He gets sick a lot for no reason, I am told this happens with these patients. I am sure it has to be the Granuflo. Why don't they fix this s*%$. I will tell you why it is the MONEY they are NOT going to lose a good thing. Do you know how much it cost to be on Dialysis for one Month. Anywhere from $45000.00 to $70000.00 we pay $60000.00 a month. They do not care for the person. God will Judge these Doctors who know what is and is not.

In 2006 my mother was having Diaylsis at a Davita Center in Hanford, Ca when she had a massive heart attack. By the time help arrived she had passed away.....

My father died June 1,2012 right after his treatment. He was on dialysis for a year or two and it was a sudden death. I still cry just thinking about my daddy not being here in my tough times.

MY MOTHER RHONDA HARRIS DIED 12/11/13 at shands Jacksonville she went in for her dialysis treatment on 12/09/13 she collapsed on shands floor and stay there for about15minutes before help arrived

My husband died in September 2011 from cardiac arrest. He had been on dialysis for approximately 10 years. One half of his heart was dead due to dialysis and the other half tried to do the work which resulted in his death.

My passed away 2/25/2005 at age 37. He was on dialysis for 5 years. Had a Kidney transplant in 1998. How and who do I file a law suit with. His death cert. states Cardiac arrest.

My mom died in 1987 just about 30 minutes to an hour after her dialysis treatment. I am not sure what medicine she was taking. Is there a timeline when this drug was used and we can file a lawsuit? How would I find out if this was something that she used?

My mother was on dialysis for seven years at a Davita facility where she went to her treatments. she was scheduled and went to supposed been an outpatient surgery where she had an unsuspected major heartatack she almost died but didn't she come out but not the same mentally or physically it was very suspicious that she had this heart attack since her heart was healthy she left hospital with a hole in her chest where they released her to a nursing home saying that when they had to crack open her ribs to pump her heart she caught an infection but doctors assured her as long as she had her wound cleaned and changed that it would close up and be ok that didn't happen she stayed at the rehabilitation / nursing home for two to three weeks where she was released home long story short I was told staff sit in went to her rib cage spread then went to her legs which led to a amputation of one of them in which they had no permission to do so but did anyway because by this time she in such bad pain they were still giving her dialysis one instance after her dialysis treatment she even had a real bad hallucination and complained she was in pain in her chest she couldn't explain how she felt but she knew she felt bad every time she went she knew sum was wrong Dr still had her go even when she declined not wanting them treatments her heart failed and she passed away 11-13_2011 her death cert says pneumonia renal failure I am her daughter and she appointed me power of attorney before she passed bottom line I believe those dialysis treatments thru my mother into cardiac arrest while she was in surgery therefore caused her a lot of pain and suffering which led to her death

My husband was on dialysis at a Fresenius site for close to 2 years. Approximately 2010 to his death in October of 2012. I am not sure of the drugs that were administered to him during this time. I know that frequently his treatments ran over due to additional drugs that were needed. Death certfiicate reads that End Stage Renal Failure was the immediate cause with other underlying causes.

I am doing this for my husband, he was on dialysis for ten years, got a new kidney in 2009, he was on dialysis from 1999 to 2009. He has stent put in in 2005 or 2006.
