Back and Neck Injury Victim Awarded $665,000 in Total Damages

Staten Island, NYA back and neck injury suffered by a 39-year-old man when his parked pickup truck was rear-ended, was awarded a total of $665,000 in compensation for his injuries.

The settlement mirrored the degree of culmination often seen in back injury lawsuits and neck injury compensation.

According to a report published by the Staten Island Advance (10/7/13), Peter Kilian was sitting in a pickup truck on the morning of February 17, 2011. An electrician by trade, Kilian was seated in a company vehicle owned by his employer at the time of the accident, Daidone Electric of Jersey City. The truck, in which Kilian was sitting, remained parked on Hylan Boulevard at Tompkins Avenue.

At about 8:15 that morning, a car driven by the defendant in the neck injury lawsuit, Lillian Perez of Clifton, struck the rear of the pickup. Kilian, according to court records, had been injured on the job some nine months prior to the accident and had only been back at work for a couple of months when he was re-injured, this time as the result of the collision.

According to the lawsuit, Kilian suffered shoulder injuries in the collision that required surgery, in addition to lower back pain and neck pain for which Kilian sought neck injury compensation.

He also made a back injury compensation claim for the pain he was suffering from his lower back. Two years after the accident, Kilian has yet to return to work and continues to receive treatment for his back and neck injury.

According to Kilian’s neck injury lawyer, the defendant’s insurance carrier paid Kilian the maximum eligible payout according to the defendant’s policy, of $50,000. The matter then went to an underinsurance claim through his employer’s insurance carrier, under a statute that allows an injured party to seek damages from the insurer of the vehicle in which the injury occurred, when reasonable damages exceed the liable party’s limitations on coverage.

In arbitration, Kilian successfully negotiated for $615,000. In total, Kilian received $665,000 in combined neck injury settlements and his back injury compensation claim. Now 41 years of age, Kilian is still in his prime earning years but has been unable to return to work, due to injuries suffered in an accident that happened while still in his 30s.

Neck injury settlements and back injury compensation is of significant importance given the seriousness and often chronic pain stemming from injuries to such sensitive and vital areas of the human body.
