Lipitor Litigation Moves Forward

Charleston, SCLipitor multidistrict litigation, alleging patients suffered Lipitor side effects and developed diabetes as a result of taking the medication, continue to move forward with regular status conferences. Three more Lipitor lawsuits have been dismissed due to failure to provide required documentation. Among the required documentation that has not been provided is a Plaintiff Fact Sheet and a response to Pfizer’s motion to dismiss.

According to court documents, in one case, the plaintiff’s lawyers have asked for more time so they can locate her. In that case (Ida Bailey v. Pfizer, Inc., No. 2:14-cv-2541), the judge dismissed without prejudice.

“Dismissal with prejudice is a particularly harsh sanction, and the Court has no information as to why Plaintiff left her former residence without providing counsel with a forwarding address or why she has been unresponsive to requests made through her family members,” Judge Richard Gergel ruled. Two other claims were dismissed with prejudice.

Lawsuits filed against Pfizer have increased dramatically since earlier in 2014. The number of lawsuits has gone up from 56 to more than 1,100 since all federally filed Lipitor lawsuits were consolidated in one action in South Carolina. The lawsuits allege patients developed Type 2 diabetes as a result of using Lipitor to lower their cholesterol levels.

Plaintiffs allege Pfizer failed to adequately warn patients and physicians about the risk of diabetes associated with the medication. Pfizer, they claim, “negligently, recklessly, and/or carelessly marketed Lipitor without adequate warnings,” according to court documents.

Pfizer had argued against centralization of the lawsuits because creation of the MDL would prompt filing of Lipitor lawsuits that were not legitimate (such as cases where the patient had diabetes prior to taking Lipitor) to force a settlement. The judicial panel on multidistrict litigation was not persuaded by the argument, finding that the MDL would help dispose of “non-viable” Lipitor lawsuits.

According to a 12-month rolling history of drug prescriptions, compiled by research firm IMS, Lipitor was number 100 on the list of drugs most prescribed in the US, with 1,085,544 prescriptions.

Lipitor is known generically as atorvastatin. Federally filed lawsuits have been consolidated into MDL No. 2502, in the US District Court of South Carolina.

I take atorvastatin "Lipitor" to control my Cholesterol Levels, Prescribed by my Cardiologist.. My blood sugar level tests in the pre-diabetic range of 116.. I have experienced weakness in my lower legs and hands and arms since taking Lipitor.. I mentioned it to my Doctor, and she just blew it off as nothing.. During my last visit to the Doctor, an Echocardiogram was performed on my heart, and the results indicated that I now have Aortic Valve Stenosis. Calcification of the Aortic Heart Valve, restricting blood flow, and working the Heart Muscle harder just to force blood through the calcified valve.. My Doctor suggested I have a Aortic Heart Valve Replacement Installed.. which I do not feel, I am a goog candidate for at age 78, plus I am 6' tall and weigh about 340 .lbs.. I struggle with mobility due to the weakened leg muscles..and walk with a cane for stablilty Personally, I believe the medications I take have cause this Aortic Valve Stenosis, because the Echocardiogram performed 2 weeks after my heart attack, the doctor advised she couldn't even tell I had suffered a heart attack..
