Attorney Cracks Down on Chiropractic Malpractice

Washington D.C.Attorney Michael Abelson became interested in chiropractic malpractice 5 years ago when a woman came to his law office in Washington D.C. and told him that her husband had died just two hours after having a neck manipulation. "He was found unconscious at home, rushed to a hospital in Maryland and died six days later," Abelson recalls. "The medical examiner found that the stroke he had suffered was caused by a chiropractic cervical manipulation," he says. The man was 39-years-old.

ChiropractorAbelson sued on behalf of the Maryland man's widow and won a wrongful death suit. He is currently looking into at least half a dozen chiropractic malpractice cases where a chiropractic manipulation is alleged to be the cause of a devastating stroke. "In each of these cases the person has suffered a disabling stroke, unable to speak or even dress themselves and these are young people," says Abelson. "The oldest one is a 49-year-old UPS driver who can no longer work."

The debate over the connection between chiropractic neck manipulation and stroke has been widely reported in the medical literature. After 5 years of handling these kinds of cases, Abelson has developed his own opinion. "I would not personally have it done now that I know what the risks are," he says. "The practice of chiropractic neck manipulation is a belief, a philosophy, and has no scientific basis," says Abelson.

Proving His Case
The first consideration for Abelson when assessing and moving forward on a chiropractic malpractice case is proving there was a deviation from the standard of care. "That means that the chiropractor failed to take a proper medical history or did not do the proper neurological tests prior to doing the manipulation," Abelson says. "Or the chiropractic adjustment may have been performed too forcefully."

"There could be a reason that a patient is not suitable for chiropractic adjustment such as a vascular anomaly or there could be signs of other vascular problems such as an aneurism," he adds. "In the cases I have handled I have found that the chiropractor has failed to do an adequate neurological work up on the patient and take an adequate history," attorney Abelson notes.

The second consideration is showing a judge or jury that the cervical adjustment was the cause of the stroke. In the case of the Maryland man the attending emergency physician, the neurologist and the medical examiner autopsy all concluded that the stroke was caused by the cervical neck manipulation," Abelson says.

The defense argued the stroke could have been triggered by the fact that the man had recently begun an Atkins diet, or that the damage might have happened while driving home.

Straight Chiropractic Treatments
All of the cases Abelson has handled involved chiropractors involved in 'Straight Chiropractic Treatment'. "It means that no matter what your complaint --whether your knees hurt, your back hurts, you have menstrual cramps or allergies," says Abelson, "these people believe that by adjusting the neck the proper energy will be released throughout your nervous system and cure all of your ailments."

Vastly Under-reported says Abelson
"These strokes may not occur for as long as two to three weeks after the manipulation," says Abelson, "That's because the manipulation can cause a dissection of the vertebral or carotid artery which will cause a slow bleed; a clot then occurs that may not break free and affect the brain until weeks later." Abelson says that the time lag means that the link between stroke and chiropractic neck manipulation is often overlooked. "That is why the connection between strokes and cervical neck manipulation is under-reported," he says. "Nobody really knows how often this happens."

Abelson knew the young Maryland man who died in 2004 personally. Since then he's become passionate about seeking compensation for people who bring actions against chiropractors for personal injury. "I work with a physician who assists me in finding experts for these cases. And it is easy to find treating medical doctors who will work with us on these cases."

Among other problems when dealing with these cases is the amount of insurance carried by the chiropractor. "In the cases I have handled, the chiropractors have carried insurance in the $1 million range. However, that is not enough to cover expenses for a young person who has been severely injured and can no longer work or care for themselves."

Chiropractors, from his point of view are vastly under insured.

We need to come together & put a stop to this. A sebring, Fl, chiropractor almost killed me, now I'm deformed, torn arteries can't be active, limited mobility & constant pain everywhere. I went there for nutritional supplements, and he decided to drop a move on me. Then falsify my medical records. We need justice I'm florida, from what I've been told , he's hurt others, but no one is getting any help. WE NEED ATTORNEYS & THE BOARD THAT LICENSES THESE QUACKS TO STEP UP & HELP

On March 22, 2016 I suffered whiplash from a car accident...I was in Monroeville shopping at HomeDepot to by some flowers. I was travelling West on Business 22 and was rear ended in the back of my car at a stop light. Soon after my chiropractor simulated my neck and I begin to have server neck pain behind my right ear and neck. My Chiropractor stated I suffered a very bad case of whiplash from being rear ended from behind and my head seem to be slicecd from my body and reattached itself to my body..
After a few weeks suffering from pain and discomfort I finally Admitted myself in the UPMC Shadyside Emergency Hospital because the pain in my neck had become unbearable and excruciating. On April 15, the hospital kept me over night on and run test on me to discover I now am being told I have anuerysm 1/4 of an inch aneurysm in the area where the pain was experience. I suffered whiplash from car accident...Soon after my chiropractor simulated my neck I had server neck pain behind my right ear and neck...Admitted my self in the Emergency hospital and was given a MRI scan and now I am told I have an aneurysm in the area where the chiropractor engaged my neck with simulator and elector therapy that was used. Now I diagnosed with a brain aneurysm.

I went to the Chiropractor for a crick on my neck from sleeping wrong. He manipulated my lower back and neck. I ended in the emergency room from severe pain on my lower back. I told him not to pretzel me again because I had spondylolesthesis. Well, he agreed not to do my lower back again, but then he did my neck, I ended up with two bulging disks on my neck and a severe case of tmj. I had another mri done of my lower back done, and now my spondylolesthesis, that had not bothered me in years was made worse. He never took a history on me, before he worked on me. I'm extremely upset. would like to find an attorney in Illinois.

The profession of chiropractic should be shut down COMPLETELY. I was so disillusioned as a result of my pain that, without doing any research, which is what I ALWAYS do before seeing anybody, or knowing ANYTHING about the "practice" of chiropractic or the "doctor," I just started seeing a chiropractor that was most visible in the area. Well let me tell you something, it was one of the biggest mistakes I ever made. 3 MAJOR herniated discs, one in cervical and two in thoracic, and resulting symptoms- excruciating pain, lack of mobility, weakness and numbness- persist STILL 6 MONTHS AFTER the last and causative visit. Tried it all, meds, injections, PT. I have to get neurosurgery now. It's amazing, the drive and power of pain. Because of IT, my impatience and most importantly, ignorance, of what I always knew innately to do, persevered right before my eyes for the five MONTHS in which I saw ... , and I failed to recognize it. My IGNORANCE COSTED ME big time, and now I'm paying for it with MUCH MORE PAIN than I ever walked in with or had in my entire life. The moral of my story: Everything aside, let it happen, but just DO NOT BE IGNORANT. Suffer through that pain for a little or even a lot longer, but DO NOT make an uninformed decision EVEN ONCE, otherwise it'll be THAT TIME you'll regret and have a different, tormenting, BRUTALIZING, want-to-rip-body parts-off kind of pain much more intense and much longer than you ever in your WILDEST of thoughts imagined possible.

Do you know of a lawyer that feels about chiropractic as you do in california? I need help since going to a DC I have damaged disc,I had an MRI done my ortho says I need surgery,Im in severe pain,I had dizzy spells during the pulling and cracking, and I still have dizzy spellss, my legs are disfigured,and painful,How can this charlatan get away with this,Im so mad and in tears,Im floored by this maniac,PLEASE PLEASE HELP ME He cannot get away! I have a really bad case of epilepsy. I have a vagal nerve stimulator (vns) which has a battery & its metal in my chest. I made it very clear to her that no kind of electro therapy should be used, just in case in interacts badly. I had gone monthes without any seizures. the day i went to my first appt the chiropractor started hooking up the electrodes to my lower back & once again i told her it wasnt a good idea. Sure enough she did anyways & claimed it wouldnt cause any problems since she would only do my lower back... When i left, my head was hurting so bad. My neck and back were even worse than when i came in. that night i ended up having one seizure after another. I called my epileptologist to explain what happened & they were very upset about it. he said anyone who practices any kind of electrotherapies should knowgbvvg NOT to to do it on anyone that has implants like the vns. I have been havinh uncontrollable seizures for over a month now & its because she was money hungry for my insurance. Its obvious. My sister was upset and called my chiropractor to see what she was thinking whbbbbbben she did that. She explained to my sistggbber that she had no idea i had a vns or epilepsy which was an absolute lie. My friend was with me when i thoroughly explained my health situation & the fact that i told her before she hooked up the eleectrodes that it was not a good idea. The pain i am going through is unimaginable & i do plan on contacting a lawyer
