The 2008 incident claimed the life of 25-year-old Daniel Rieman, who was struck by a drunk driver while walking home one day. The driver of that vehicle, Curtis W. Martensmeyer, had been drinking at a party beforehand despite the fact that he was underage at the time.

The Riemans have filed suit against the unknown hosts of the graduation party that Mertensmeyer attended, claiming that the owners illegally provided alcohol to minors and endangered the lives of others by allowing them to drive home.
"It did kill my son," Kelly Riemann, the victim's mother, told KCTV5.com. "And for them to think that they are not accountable and to walk away from this… It is not OK. My son was killed because of it. Those parents knew just like me what they did was illegal."
