A Potpourri of New York Unpaid Wages Lawsuits

A nationwide Chipotle class action is also a New York Donning and Doffing lawsuit given that Chipotle has a healthy presence in New York State, and thousands of potential class participants alleged they worked off the clock on a routine basis. The end result, according to allegations asserted in the class action, is wage theft.

The lawsuit – whose class participants thus far approach 10,000 – argues that a timekeeping system employed by Chipotle is set to automatically clock their employees out at 12:30am, in spite of many employees claiming they had yet to complete their mandated tasks and allege to have worked beyond 12:30am. Having been clocked out automatically, the employees were effectively toiling on behalf of their employer on their own time, and thus allege wage theft.

The lawsuit also alleges that store managers are tasked with controlling costs to such a degree that plaintiffs claim store managers are reduced to altering time records after the fact.

Some employees argue they frequently worked five, or more unpaid hours per week. The lead plaintiff in the class action asserts she worked hundreds, or even thousands of hours without compensation over several years with Chipotle. A manager, Leah Turner alleges the ability for her to remain in her managerial position hinged on her capacity to keep labor numbers low.

Other New York Unpaid Wages lawsuits make similar allegations of wage theft.

A class action New York Employment lawsuit filed by lead plaintiffs Eric Meindl and Anthony Negron assert alleged violations of labor statutes resulted in unpaid wages, unpaid minimum wages, unpaid overtime, unlawful deductions, and notice and record-keeping violations under the Fair Labor Standards Act and New York Labor Law.

The case is Meindl et al v. Mobility Center, Inc. d/b/a I Fix Screens et al, Case No. 2:26-cv-05894, filed October 24 of this year in US District Court, Eastern District of New York.

Still another New York Unpaid Wages lawsuit was filed at the end of September alleging wage theft. The lawsuit seeks to recover unpaid overtime due to an invalid tip credit, unpaid minimum wages, liquidated damages, attorneys’ fees and costs pursuant to the Fair Labor Standards Act.

The lawsuit is Ramirez et al v. Dining Entertainment Group LLC et al, Case No. 1:16-cv-07692 filed September 30th of this year in US District Court, Southern District of New York.
