Creditor Held in Contempt of Court for Violating Automatic Stay

Miami, FL (January 24, 2018) A Florida judge signed an order today holding creditor, IH5 Property Florida LP with GP IH5 Borrower GP LLC, more commonly known as Invitation Homes, in contempt of court for intentional violation of the automatic stay. Miami bankruptcy attorney, Timothy S. Kingcade’s client filed a Chapter 7 petition on November 30, 2017. Despite having notice of the bankruptcy filing, on December 5, 2017, the creditor, Invitation Homes, proceeded to file an eviction action against the client. Attorney Kingcade filed a motion to hold the landlord in contempt of court for violating the automatic stay. The motion adequately showed that Isamar Alers of Invitation Homes had actual knowledge of the bankruptcy on November 30.

The Future of Takata Airbag Claims

Orlando, FL:At the beginning of last year, Takata—the automotive parts company behind the largest automotive recall in the nation’s history—entered into a plea agreement with the United States Department of Justice (DOJ). The company then declared bankruptcy a few months later, setting off an avalanche of legal filings throughout the world, with an international corporate restructuring effort continuing to this day. “It’s critical to remember that as this process plays out, consumers have and will continue to be hurt and killed by rupturing airbags,” says attorney Frank Melton of Newsome Melton, PA.

Knee Replacement Recipient is “Done with Surgeries”

Tampa, FL: The pain started right after Sandra had a Smith & Nephew knee replacement. “It never functioned properly and I never did get back a full range of motion like I was told,” says Sandra. “I had this metal-on-metal knee implant because my knee was bone-on-bone. This knee implant was supposed to make me better, not worse.”

Healthcare Whistle Blower Awarded $351,000

Tampa, FL: It did not take long for Kathleen Siwicki to notice something was very wrong in the Florida cardiologist’s office where she was working. Siwicki, an experienced Certified Cardiovascular Technologist, immediately began to see the services the doctor was providing did not match the billing statements he was submitting for payment. In November 2014, after just six months working for Dr. Arthur Portnow she quit her job and shortly after filed an action under the False Claims Act.

Florida Premises Liability Case Comes Down to Rule of Law

Ocala, FL: A Florida premises liability lawsuit that stemmed from a slip and fall incident in 2011 came down to the weight of the evidence, together with the legal definition of the plaintiff as a visitor to the premises – an issue that had a bearing on the unsuccessful bid to have the finding of a lower court stayed, and a petition for a new trial denied.
