Kmart settles healthcare fraud lawsuit for $32.3 million

Washington, DC The Department of Justice announced that Kmart Corporation has agreed to pay $32.3 million ($59 million including state law issues) to settle a lawsuit that claims in-store pharmacies overbilled Medicare Part D, Medicaid, and TRICARE. The healthcare fraud scheme, which a Kmart pharmacist stumbled upon only when he had his own prescription filled, allegedly affected drug reimbursements in 46 states. The pharmacist was awarded $9.3 million under the whistleblower qui-tam provisions of the False Claims Act (FCA).

Jungle Trux Drivers the Latest to Challenge Unpaid Meal and Rest Breaks

Seattle, WA: Amazon and Jungle Trux, based in King County, WA, have started the new year facing an unpaid overtime and employment class action lawsuit. The lawsuit was filed by two package delivery drivers who allege Jungle Trux and Amazon failed to pay them overtime, undercounted their hours, and failed to provide them with required breaks.

Second Testosterone Bellwether Lawsuit Wraps in Illinois

Chicago, IL: The second bellwether testosterone lawsuit in testosterone multidistrict litigation ended in similar fashion to the first: a sizeable punitive damages award, together with a jury finding that defendant AbbVie Inc. was not liable for heart issues suffered by the plaintiffs in the respective trials.

Recent Monsanto Roundup Lawsuit Targets Alleged Marketing Violations

Madison, WI: The basket of Monsanto Roundup lawsuits has grown, with another class action launched June 20 of this year in Wisconsin (Blitz et al. v. Monsanto Company et al., Case No. 3:17-cv-00473, United States District Court, Western District of Wisconsin). In this most recent claim, plaintiffs from Wisconsin, Illinois, California, New York, New Jersey and Florida assert that the product is marketed in a false and misleading manner.
