Masonite Corporation
Judy Naef owns structures with exterior Masonite Hardboard Siding and brought a case against defendants Masonite Corporation and International Paper Company claiming relief based on theories of negligence, breach of express warranties, and fraud.
The plaintiff alleged that installing hardboard siding manufactured by Masonite Corporation into homes and commercial properties lead to rotting, buckling, discoloring, deteriorating, and damage to other structural parts of the buildings.
The Circuit Court of Mobile County, AL, granted final approval to a settlement between plaintiffs and defendants. However, no determination was made on the issues of defendant's liability or the amount of any damages.
The settlement agreement contains a compensation formula, which will entitle the claimant to claim damages for the structure as per the average cost per square foot for siding replacement. However, if the damage is more than 50% to 75% of a wall section, then the claimant will receive compensation, as determined by the compensation formula, for that entire wall section.
