The town of Wallkill has been fighting this local sand and gravel business for years. Wallkill filed a lawsuit against CM for allegedly violating town and state environmental laws by allowing workers to trample federally protected wetlands. A Supreme Court judge in Goshen approved a settlement that includes an undisclosed monetary compensation to the town. The settlement also requires the company to test private water wells in the neighborhood and it gives the town access to the plant to conduct annual inspections. (JUn-22-05) [RECORD ONLINE]
