I. ACCIDENT FACTS:
This automobile accident occurred on February 10, 2003 in Nueces County, Texas at approximately 6:15 in the morning when the vehicle being driven by Emilio Garza, Jr. was struck on the left side on US-77 in Nueces County, Texas, by a vehicle being operated by Manuel Pineda Contreras. During the impact, the driver's-side door of the "vehicle in question" opened and Emilio Garza, Jr. was ejected into the roadway and rendered incapacitated. He was subsequently struck by a tractor/trailer and died as a result of his injuries.
II. LIABILITY:
This product defect involves the failure of the doors to stay closed during a foreseeable accident. The driver's side door opened in this case, which created a large portal that allowed ejection. The vehicle is also prone to door latch failure due to actuation of the door latch mechanism.
III. DAMAGES
As a result of the accident in question, Emilio Garza, Jr., sustained excruciating pain, mental anguish, and terror prior to his death. His estate is entitled to recover for his mental anguish, physical pain, and necessary funeral bills and expenses. His wrongful death beneficiaries are his biological parents, Emilio Garza, Sr. and Paula Garza
