On July 13, 2003 police responded to a disturbance call regarding 25 year old Cau Bich Tran. The 4 foot 9 inch, 98 pound Vietnamese mother of two spoke little English and did not open her apartment door when the police arrived. San Jose Officer Chad Marshall entered Tran's home and began to open fire at her as he thought she was holding a clever. The 'clever' was actually a vegetable peeler and Tran died from a gun shot wound to her heart. Her family filed a wrongful death lawsuit against the city and was awarded a $1.825 million settlement.
