EPT Management Co., TVO Hampton Village Partners LP and TVO Hampton, Inc.

Two male individuals attacked the plaintiff in the hall outside her apartment and forced her into her home at Hampton Village Apartments. They then threatened the plaintiff, viciously assaulted and battered her, raped her at gunpoint and fled the scene. The plaintiff contended that prior to the time that she was attacked, the defendants were on actual notice of violent crimes occurring on their premises, and that the attack was foreseeable. A jury in the state court of Fulton County, Georgia came to a $9 million verdict for the plaintiff's damages. (Dec-14-05)
