City of Espanola, NM
In August 2004, 8-year-old Jerry Trujillo was sent to the school counselor's office after he hit another child with a basketball. Jerry then allegedly went out of control and refused to return to class. The police were summoned; they handcuffed the third grader and took him to the city jail where he was dressed in an orange jumpsuit and placed in a holding cell while adult inmates in a nearby cell taunted him. The Trujillo family filed a lawsuit against the city and was awarded a $221,000 settlement. (Apr-14-06)
