LAWSUITS NEWS & LEGAL INFORMATION
Jockeys Guild
In July of 2004, jockey Gary Birzer was riding Lil Bit of Rough when the thoroughbred made her move in the first turn at Mountaineer Racetrack & Gaming Resort. The 110-pound jockey was thrown headfirst into the dirt at 40 mph. Birzer broke his neck and was left permanently paralyzed from the chest down. The Jockey Guild usually pays $10 per race for an insurance policy to cover jockey injuries. Unfortunately, Birzer's policy was inexplicably allowed to lapse. Birzer sued the Guild for $10 million in damages and personal injuries. The financial terms of the settlement were not disclosed, but the settlement does include five years of health insurance coverage for Birzer and his family as well as a public role with the Guild, advocating for other disabled jockeys.
