Gerald Barnett took Vioxx for 33 months before suffering a heart attack in September 2002. The former FBI agent filed a lawsuit against Merck for compensatory and punitive damages. A New Orleans jury ruled Merck was negligent for failing to adequately warn doctors about the risks associated with the drug. The jury also found that Merck knowingly misrepresented or failed to disclose information about Vioxx to the doctors of 62-year-old Gerald Barnett. Merck has been ordered to pay Barnett at $51 million settlement. (Aug-17-06)
