John Wirta
This is a settlement for the DUI/DWI lawsuit.
New York - On October 22, 2004 Angel Reyes, 12, and his friend Vasean Alleyne, 11, tried to cross a street in Queens, NY. John Wirta's van struck Angel and Vasean; Vasean died and Angel suffered brain damage. Wirta was intoxicated at the time of the hit and run accident, but was only charged with misdemeanor drunken driving because there was no aggravating factor such as speeding or running a red light. He served 38 days of a 60-day sentence. Angel's parents filed a lawsuit against Wirta and have settled for $2.5 million. The Driving While Intoxicated (DWI) incident prompted sticker laws in New York; the state now notes that if one is DWI and causes death or serious injury the penalty is now a serious felony.
