Middletown, NY: At 3 am on April 9, 2005, police got a call from a Kennedy Fried Chicken restaurant complaining that a man had left without paying for his $5.50 chicken dinner. Officer Patrick Moser responded to the call and arrested Jacob Fitzgerald. During the arrest, Fitzgerald suffered a broken jaw. He filed a lawsuit against the city and claimed Moser used excessive force and punched him without provocation. Moser was fired from his job after he was caught lying about details of the arrest and faces jail time for perjury and official misconduct. The City of Middletown has agreed to pay Fitzgerald a $400,000 settlement. (Nov-21-06)
