Gardner, KS: (Mar-20-07) A ten-year legal dispute between the city of Gardner and it's architect Tappé Associates of Boston over responsibility of the potentially dangerous flaw in construction, was finally resolved in an out-of-court settlement. The Gardner Middle School building operates on a temporary occupancy permit owing to serious flaws in the building that render it potentially dangerous. In the settlement agreement reached, Tappé Associates will pay $185,000 to be used in reconstructing the walls of the school.
