Cedar Falls, IA: (Apr-19-07) Tracey Toles brought a lawsuit against the city and officer Joel Oltrogge, claiming that the Cedar Falls police officer broke her thumb during a fight at a junior high football game. Toles also alleged that her Constitutional Rights were violated by excessive use of force. The suit stemmed from a brawl at a September 2003 football game between Waterloo Central Middle School and Holmes Junior High. The game was played at the Holmes football field. Toles contended that Oltrogge had taken her daughter, Danaila Toles, to the ground and put his knee in her back. Toles said that on inquiring why her daughter was being arrested, Oltrogge grabbed her thumb and forced her arm behind her back, causing her to later have surgery on her thumb. Oltrogge was terminated in September 2006 for violating city uniform allowance policy. The city settled the civil rights violation lawsuit with a $35,000 payout to Toles.
