Total Transportation Services LLC

Plano, TX: (Apr-30-07) Memphis-based Exel Transportation Services Inc. (ETS) filed suit against Texas-based Total Transportation Services LLC (TTS), over the conduct of two former TTS employees who left the company in April 2006. The suit, involving the unethical business practices of the two former TTS employees, reached a settlement when Total Transportation Services agreed to pay Exel Transportation Services $10 million as a twenty month restriction on the solicitation, hiring or contracting with ETS agents or sales agents by TTS. For 18 months TTS has agreed to pay to ETS 10% of TTS' gross margin for any business TTS does with ETS' top 25 customers. The suit ended amicably with TTS deciding to compete with ETS fairly, but fiercely in the marketplace, and not tolerate any activities that appear out of line, such as those which had led them to this suit.
