Hayward Unified School District
Hayward, CA: (May-06-07) The Castro family filed a lawsuit against the Hayward Unified School District, following the death of 15-year-old Celedonia Jasmin Castro, who was killed by a commuter train in February 2005 on the railroad tracks behind Tennyson High School. The suit claimed that a lack of supervision by school officials at the Huntwood Avenue gate led to Celedonia's death. An Alameda Superior Court Judge Gordon Baranco prepared to impanel a jury on March 28, prior to which HUSD came to an agreement with Roberto and Maria Castro, parents of Jasmin Castro, and ended the suit with a financial settlement of $200,000. The parents were unhappy with the settlement, but several factors played a part in the ruling. Celedonia's autopsy revealing a blood-alcohol level of 0.06, the boy Celedonia saved from the train was convicted of involuntary manslaughter, and the two were playing chicken with the train when Celedonia pushed him out of the way and was hit herself.
