San Francisco, CA: (May-08-07) The 49ers football team filed claims against San Francisco, alleging that the city has been a negligent landlord. According to the charges filed, the team had threatened to file a lawsuit, having complained for years about leaks in luxury suites, rusty light towers and steps, cracked walkways, clogged drains in concession stands, broken escalators and elevators, periodic flooding of parking lots and even the collapse of equipment into areas where fans could have been injured had a game been scheduled. The team pays about $6.5 million in rent to use Monster Park 10 to 12 days a year, and roughly $2.5 million in taxes and other revenue. The city rejected the 49ers' legal claim, claiming that it had satisfied the terms of the team's lease, which was signed in 1969 and amended numerous times in the intervening years. However, it agreed to defer payment of some of the 49ers' 2007 rent pending negotiations. Over the last three years, the city has given the team rent credits totaling $4.2 million to pay the 49ers back for maintenance and repairs. The four-year rent credit agreement, which is set to go before the Board of Supervisors, carries hope for the 49ers that the proposed settlement of $10.3 million will go towards paying for stadium maintenance projects that the city approves.
