Huber Heights City, OH: (May-17-07) TDEL, LLC filed charges against Huber Heights City over .035 acres of land at the northwest corner of the I-70 and St. Rt. 202 interchange, formerly a Shell gas station. The suit stated that various parcels of right-of-way were acquired. The Montgomery County Transportation Improvement District took approximately .035 acre from a parcel on this property. As a part of the litigation, $18,000 was offered for the property taken. The amount was initially refused, but eventually TDEL accepted the money. The dispute centers on the damage to the residue, since the original parcel was about .561 acres, less the .035 acre taken left .526 of an acre. TDEL felt the remaining .526 acre had been damaged by the take. IHuber Heights City Council approved a settlement agreement with TDEL, LLC for $110,000 plus another $18,000 previously agreed upon.
