Upper Peninsula Power Co.
Marquette, WI: (May-23-07) Marquette County filed lawsuits against Upper Peninsula Power Co. (UPPCO), MWH Engineering of Broomfield, CO. and Moyle Construction Co. of Houghton in 2005 for $79,230.86 of the $100,000 losses the county sustained during the May 2003 flood on the Dead River. The Dead River flooded when the Silver Lake Basin dike was breached due to a fuse plug failing. The failure resulted in about 8 billion gallons of water being released into the Dead River.
The county incurred expenses, including having to put the Marquette County Sheriff's office and the Emergency Operations Center on 24-hour alert. There was also damage to the Badger Creek drainage system. The damage from flooding of the river and the failure of the dam resulted in a total damages estimated at $102 million, including $127,000 in emergency and public safety costs, $3 million in damage to roads and bridges, $10.4 million in damaged or destroyed utilities, $4 million to the Dead River fisheries, soils and trees, and $84 million in economic losses. Nearly 1,800 residents were forced to evacuate their homes.
UPPCO owns and operates the water level controls at the Silver Lake Basin, MWH designed the fuse plug release system, and Moyle was the general contractor that installed the fuse plug. In a settlement reached, Upper Peninsula Power Co. and MWH Engineering agreed to pay a combined $50,000. [MINING JOURNAL: DAM FLOODING]
