Delaware County, OH: (May-24-07) Steven Foster, a Galena man who claimed he was beaten by corrections officers in the Delaware County Jail, filed suit against the county. The suit alleged that when Foster was sent to the county jail for a probation violation in September 2001, he was writing a letter in his cell when three corrections officers allegedly entered the cell and punched him in the face, slammed his face into the floor, bent his legs behind him and ground a flashlight into his back.
The lawsuit was filed in 2003 against former Sheriff Al Myers, the three corrections officers, and others stemming from the incident. His complaint stated he was slated to be evaluated for back surgery at the time he was incarcerated. The suit also alleged no one responded to Foster's cries for help for the six hours following the assault, and he was denied immediate medical care despite having a pre-existing back injury. Foster alleged he suffered recurring lower back pain, numbness below one knee and permanent nerve injury, which affected his ability to use his foot. He also maintained he now had no motor skills in his right foot and must wear a plastic brace on the foot in order to walk.
In a settlement reached, Delaware County commissioners agreed to pay Foster $100,000 to settle the lawsuit, in a bid to avoid the costs of protracted litigation. Foster's settlement represents the second time in two years the county has paid $100,000 to settle a lawsuit with a former county inmate. In December 2005, Jacqueline Roush received that sum to settle a suit claiming corrections officials failed to provide adequate medical treatment during her 15-day stay at the jail.
