Gardens Manufactured Home Community
This is a settlement for the Commercial lawsuit.
Olmsted, OH: (May-30-07) Residents of the Gardens Manufactured Home Community filed a class action lawsuit against the owners in fall 2004, alleging consumer fraud, breach of contract, and violations of state and local laws. The Gardens is east of US 63 at 40th Street Southeast. The development has 129 home sites and opened in 2000. Residents own the manufactured homes, but lease the lots on which they are located. The suit claimed that the defendants induced the residents to lease the houses by advertising amenities they knew could not be provided. There also were individual warranty and construction-related claims that were separated from the civil suit and were settled through arbitration.
In an agreement reached, the two and a half year old suit ended with the owners of the Gardens Manufactured Home Community agreeing to pay $525,000 in an out-of-court settlement. Olmsted District Judge Joseph Wieners signed the final order and judgment May 7, 2007. The 15 named plaintiffs were individually awarded class representative awards of between $2,000 and $3,000.
