Enfield, CT: (Jun-06-07) Pinney Construction Corporation, a Cromwell-based construction company, filed suit against the town, alleging it breached their contract in failing to compensate the contractor for extra work, specifically the demolition and rebuilding of the library's three chimneys. Pinney Construction claimed the town increased the project's scope without extending the completion deadline, continually obstructed its ability to complete the work on schedule, and did not pay it for work done in accordance with the contract.
Enfield contracted Pinney Construction in June 2006 to restore the exterior of the Pearl Street Library. The work included replacing or repairing the building's gutters, trim, roof, doors windows, chimneys, and entrance steps, according to the bid request. Pinney Construction was the sole bidder on the project and the contract was originally for $344,347 and set a completion deadline of Oct. 2, 2006. A change order issued during the work raised the contract amount to $361,065. In a settlement reached, the town council agreed to pay Pinney about $80,000 to resolve the claims.
