Visalia, CA: (Jun-07-07) Restoration Inc., a city church, and the city resolved their long standing dispute over ownership of a theater, after the city agreed to pay $672,000 for the theater as a settlement. In 2004, Restoration made a $600,000 offer to buy the Main Street Theater after the Enchanted Playhouse children's theater failed to come up with enough money to purchase the building on its own. Concluding that a church of any kind would be an inappropriate use of the building on Main Street, the Visalia City Council voted to condemn the property under eminent domain, halting Restoration's intended purchase while it was in escrow.
Owners of the theater challenged the city's eminent-domain action even after Restoration and the city settled, asking more than $868,706 in compensation, including reimbursement of attorneys' fees. That was later reduced to $672,000, just $72,000 more than Restoration originally offered the owners in 2004. Later, Restoration Inc. told the city in a letter that it no longer needs the theater.
