San Luis Obispo, CA: (Jun-14-07) Jesus Macias, father of 8-year-old Kimberly Macias, filed a wrongful death lawsuit against the city of San Luis Obispo and Annie Tong-Try, the driver of the car that struck and killed Kimberly Macias. The accident occurred on Halloween night in 2005, when the Atascadero girl was trick-or-treating with adults. Annie Tong-Try, 22, the driver of the car that struck and killed Kimberly Macias, pleaded no contest to misdemeanor vehicular manslaughter. A no-contest plea results in a conviction without admitting guilt. She is expected to be sentenced to three years of probation and have her driver's license taken away for three years.
In a settlement reached, the agencies agreed to pay about $100,000 combined. Annie Tong-Try's insurance company also agreed to pay $100,000 to the family.
