Oakland County Drain Commission, the Pontiac Lake Property Owner's Association, and the Pontiac Lake Improvement Board
White Lake Township, MI: (Jun-20-07) Christine Rushford filed a lawsuit against the Oakland County Drain Commission, the Pontiac Lake Property Owner's Association, and the Pontiac Lake Improvement Board, alleging that the Pontiac Lake's high water levels were responsible for the flooding on her property. Rushford, who lives on a piece of property sometimes known as Belenger Island, claimed that a few individuals who did not abide by a "no wake" zone on the lake near her property caused flooding on her property. Rushford said water, which is higher than the lake's legal summer limit, 962.83 feet above sea level, in part, lead to the flooding. A report from the Oakland County Drain Commissioners Office showed that the lake was at 963.45 feet above sea level, or 0.62 feet above sea level higher than the summer legal level for Pontiac Lake. The lawsuit alleged that the defendants separately or collectively caused damage to her property as a result of the establishment and maintenance of a lake level at Pontiac Lake in excess of that allowed under law. The lawsuit was filed in May 2006, and reached a settlement where Rushford was awarded $25,000 which would be applied to the construction of a seawall and would be paid in $10,000, $3,000, and $12,000 installments.
